The BOE of 4 November 2026 publishes Royal Decree-Law 32/2026, of 3 November, the instrument with which the Government structures the public response to the Urda rail accident (Toledo), which occurred on 28 October at kilometre point 118 of the Madrid-Seville line, when a Renfe AVE train carrying 397 passengers collided from behind with an Iryo train carrying 147 travellers. The accident left 69 dead and more than a hundred injured, as stated in the preamble of the regulation itself.

The fine print of this royal decree-law is of particular interest to the legal profession: it creates a public aid system that coexists with civil liability compensation, sets up an advance-payment mechanism with State subrogation into credit rights, and fixes application deadlines that are worth tracking from now on.

What aid is created and for whom

The beneficiaries are the victims of the trains involved, under the same definition as Royal Decree 627/2014, of 18 July, on assistance to victims of rail accidents and their relatives: people injured or killed as a result of being involuntarily and directly involved in the accident. Article 2 specifies that payment requires the status of passenger, train driver, staff in training or onboard staff of the affected trains, in any of their categories.

The amounts in article 3 are as follows:

  • Death: 72,121.46 euros per deceased person.
  • Bodily injuries: a scale of fourteen categories referenced to the Compulsory Passenger Insurance Regulation, ranging from 84,141.70 euros (category 1) to 2,404.04 euros (category 14), including 60,101.22 euros (category 2), 30,050.60 euros (category 7) and 12,020.24 euros (category 10).

One relevant practical point: the aid is granted "irrespective of any subsequent determination of liability". It does not replace compensation arising from the civil liability of the rail operators or the infrastructure manager; it is compatible with it and with the benefits under Regulation (EU) 2021/782 on rail passengers' rights, as article 6 expressly acknowledges.

The legal status of the aid

Article 7 sets three features that organize any advice to victims. First, the aid for damages suffered is non-reimbursable by the victims. Second, it is exempt from personal income tax (IRPF). Third, the General Subsidies Act 38/2003 does not apply, nor does any requirement in other laws for obtaining subsidies, except the supplementary application of its title IV for matters not provided for; even so, the aid must respect the principles of publicity, transparency, objectivity, equality and non-discrimination. The same provision makes clear that the aid does not replace the responsibilities and obligations of railway undertakings, infrastructure managers and public administrations established in Regulation (EU) 2021/782, Royal Decree 627/2014, Royal Decree 1575/1989 and the rest of the applicable sectoral rules: the public aid system is superimposed on the operator's obligations, it does not substitute them.

Procedure: a three-month window from the activating resolution

Management falls to the Secretary of State for Transport and Sustainable Mobility, with the Directorate-General for Road and Rail Transport acting as the instructing body. The procedure will be launched by a resolution setting out how to apply for the aid; once published, a three-month application window will open, extendable for justified cause.

The process provides a ten-working-day correction period, a provisional resolution proposal with a ten-working-day hearing, and a final resolution ending the administrative route. Payment will be made in a single instalment after notification of the grant, and beneficiaries are exempted from providing guarantees. The electronic headquarters of the Ministry of Transport will serve as the publication channel for the procedure's administrative acts.

The compensation advance and State subrogation

The first additional provision introduces the most novel piece for law firms' work: beneficiaries may request additional aid as an advance on the civil liability compensation that may be recognised in the future. The advance equals the amount of the article 3 aid.

In exchange, the State is subrogated into the beneficiary's credit rights up to the amount advanced, and that credit has the status of a public-law receivable, collectible under the General Budgetary Law procedure. The regulation protects the injured party in both scenarios: if the final compensation is lower than the advance, the difference does not have to be returned; if it is higher, the excess is paid. To fund this mechanism, an extraordinary credit of 15,309,165.24 euros is approved, extendable and incorporable.

The procedure is coordinated with the criminal route: the court hearing the proceedings arising from the accident will provide the administrative instructor with the necessary information on compensation already deposited or paid, respecting proceedings declared secret or reserved. If the judicial information does not arrive within one month, the deadline for resolving the advance aid is suspended, without affecting the ordinary article 3 aid.

The Adamuz and Gélida precedent and the constitutional footing

The design does not start from scratch. The statement of reasons recalls that the Government approved Royal Decree-Law 1/2026, of 27 January, on aid for the victims of the railway accidents of Adamuz (Córdoba) and Gélida (Barcelona), and that the experience of its application demonstrated the usefulness of having specific mechanisms for immediate economic support. The new royal decree-law's first final provision completes that system retroactively: it incorporates into RDL 1/2026 the same judicial-administrative coordination - the instructor's access to information on compensation already advanced, deposited or paid, and the suspension of the deadline if the judicial information does not arrive within a month - that the Urda chapter has just created.

The rule relies on the extraordinary and urgent need of article 86 of the Constitution, justified by the seriousness of the accident and the need for an immediate response, citing the constitutional case law on the use of the decree-law, and on the competences of rules 1, 7, 13, 14, 17, 18 and 21 of article 149.1. It entered into force on the very day of its publication, 4 November 2026.

One-stop support offices and employment protection for those affected

The second additional provision orders the creation of one-stop support offices in the Government delegations and sub-delegations of the regions where the affected persons reside, to facilitate the filing of applications. The regulation expressly authorises the communication of personal data between administrations to identify and locate victims, under article 8 of Organic Law 3/2018.

In addition, the third additional provision shields workers who could not reach their workplace or arrive on time because of the accident or service disruptions: they may not be sanctioned or suffer any employment detriment, and rail companies must provide proof of the incidents. The fourth additional provision treats as a work accident, exceptionally and for economic purposes, temporary incapacity processes started before 30 November 2026 and pensions arising from the accident, with the difference funded from the State Budget.

What lawyers should review now

First, the calendar: the three-month application window is calculated from publication of the Secretary of State's resolution developing the procedure, so the Ministry of Transport's electronic headquarters should be monitored. Second, the claims strategy: whether or not to request the advance determines the State's subrogation into the compensation credit, a decision to be weighed case by case. Third, the limitation period of civil liability actions, which follows its own course regardless of the administrative aid system.

The same regulation introduces, in another field, a cap on price increases in emergency situations that we analyse in depth in a separate article.

Frequently asked questions

How much does the family of a person killed in the Urda accident receive? The public aid is 72,121.46 euros per deceased person, compatible with insurance compensation and with the corresponding civil liability claim.

Can I request an advance on future compensation? Yes. The first additional provision allows requesting an advance equal to the aid, with State subrogation into the credit up to that amount. If the final compensation is lower, the difference is not returned.

When can the aid be requested? The three-month window will start when the Secretary of State for Transport publishes the resolution regulating the application, whose status and date must be checked at the Ministry of Transport electronic headquarters.

Does the aid replace a judicial claim? No. It is compatible with compulsory passenger insurance compensation, with Regulation (EU) 2021/782 and with civil liability actions.
