Does a nota simple expire? Issue dates and when to request an updated copy

Updated 21 October 2026 · 7 min read

An ordinary nota simple describes the registered position reflected in that document; it does not update itself. Do not apply a universal three-month expiry rule to every use. Whether it is suitable depends on its issue date, your purpose and the requirements of the person receiving it. For an upcoming transaction, ask the professional handling it what fresh information is needed.

What an updated nota simple actually means

A nota simple received some time ago does not change when the Land Registry changes. It retains the information it contained when issued. Spain's Colegio de Registradores describes the ordinary note as a snapshot of a property at a particular moment. This is why a genuine document may still be unsuitable for assessing a later purchase: authenticity and freshness answer different questions.

Article 222.5 of Spain's Mortgage Law, linked here to the BOE consolidated text, establishes the note's informational character and its reference to current entries. It does not mean that a PDF you saved receives subsequent registrations. Nor does the document's age guarantee that nothing has happened since. Read its issue date and the specific information it contains before relying on it.

Is there a general three-month expiry date?

You should not present three months, thirty days or another fixed period as the universal rule for every note and every procedure. The official sources cited explain the document's informational value and its relationship to a particular registered position. They do not set a single acceptance period for every recipient. If a bank or another organisation asks for recent paperwork, confirm that requirement with that organisation.

The useful question is not simply whether the file still opens or can be verified. It is whether its information is appropriate for the decision you are making today. An old note may help identify the registered property or prepare questions. That does not make it sufficient evidence of the current position before you commit money. Keep historical background separate from a fresh check for a new transaction.

Which dates should you check?

Start with the issue date and, where shown, the time. Then put that information alongside your transaction: when the proposal arrived, when signing is planned and what relevant events you know about since the note was issued. You do not need to invent a legal deadline to recognise that a purchase taking place months later deserves a discussion about updated information.

Do not confuse the date you downloaded a file with the date of its contents. Renaming a PDF or saving it again does not refresh the registered information. If somebody forwards a note, keep the complete document and check its identification. A cropped screenshot may omit precisely the date you need. Ask for the full document if the version supplied is incomplete or difficult to read.

When a fresh request can be useful

If you are buying, arranging finance or reviewing security over a property, ask the professional responsible what document is required and how recent it should be. A sensible practical approach is to match the check to the importance and timing of the decision, rather than ordering notes repeatedly without a purpose. A newer note is not a replacement for reviewing the deed or other aspects of the proposed transaction.

Fresh information can also be useful after a change intended to reach the Registry, such as the cancellation of a mortgage entry. In that case, do more than compare dates: check that the document concerns the same registered property and the particular right you are investigating. If the change is not reflected, ask about the procedure's status. Starting a process is not the same as having it completed.

An ordinary PDF is different from continuing information

The official Registradores service page distinguishes an ordinary note from continuing information. The latter provides updated information during the period and under the conditions of that particular service. Ordering an ordinary nota simple over the internet does not, by itself, turn it into ongoing monitoring. Online may refer to the request channel rather than continuous updates to the file delivered to you.

Check the exact service name and its current terms before choosing it. This guide does not assign one commercial duration to every product or promise automatic alerts. Article 222.3 also states that continuing information does not change the nature of the form of registry information chosen. More recent information does not automatically become a registry certificate with a different legal value.

A recent note is still not a registry certificate

The legal value of a document is not determined by its date alone. Article 225 of the Mortgage Law provides for registry certification when establishing freedom from, or the existence of, encumbrances against third parties. Ask whether your recipient needs an informational note to assess a transaction or a certification for the relevant evidential purpose.

Do not choose the more expensive document merely out of anxiety, or the cheaper one without checking its purpose. Confirm what it must establish and who will rely on it. Updating a note may improve the information available, but it does not change its legal category. It also does not ensure acceptance under every organisation's documentation rules. This distinction applies whether the reader is in Spain or reviewing a Spanish property from abroad.

Comparing an older note with a newer one

First confirm the property's identity: Registry, municipality, registered property number and CRU where shown. A home, parking space and storage unit may need separate checks if registered as separate properties. Do not treat a missing charge as proof of cancellation before confirming that you are reading information about the same registered property. Marketing names and informal addresses do not replace registry identifiers.

Next compare ownership, rights and charges without isolating a single sentence. A registered mortgage does not, on its own, tell you the outstanding loan balance. If a description changes or an unfamiliar entry appears, record your question and ask the Registry or the professional handling the transaction. Do not edit the PDF to produce a supposedly corrected official version. Keep both documents as records of what was supplied.

Prepare a focused request rather than repeated checks

Gather the verified property identifiers and explain your genuine interest in the information. The Registry assesses the interest of the person requesting access; having an older note does not remove that assessment. If you act for someone else, check the scope of the instruction and the intended recipient. A new request should serve a concrete, legitimate purpose, not general curiosity about another person's assets.

When the document arrives, check that it matches the request and keep the receipt separately. Raise questions before taking on commitments that may be difficult to reverse. If you are working in English, avoid turning an informal translation into a claim about what the original Spanish entry legally means. Ask for clarification of the original wording where a charge or restriction affects your decision.

Use the right check for the next decision

An old note is not worthless simply because it is old. It can remain useful background. The mistake is treating that background as a live feed of the Registry or a guarantee that the property has not changed. Equally, a recent issue date does not remove the need to understand the entries and the limits of the document.

This guide explains documentary freshness in general terms. It is not a legal review of a specific property or a promise that Agente Lex can issue or deliver registry documents. Verify the current conditions of the official channel when you intend to use it, and agree the appropriate documentary check with the professional responsible for your transaction.

Frequently asked questions

Does a nota simple become invalid after three months?

Do not apply that period as a universal expiry rule. Suitability depends on the issue date, intended use and recipient requirements. Ask what recent information your particular transaction requires.

Does downloading the same PDF again update it?

No. Saving an existing file again does not change its contents. Distinguish a new issue or fresh consultation from another copy of the document you already hold.

Does a recent note prove that the owner has no debts?

No. Read the rights and charges and distinguish registry information from other checks. A mortgage entry, for example, does not establish the current outstanding loan balance.

Is continuing information the same as a registry certificate?

Not necessarily. The law states that continuing information does not change the nature or legal value of the selected form of registry information.
