Catalonia declares 53 municipalities stressed residential market areas and extends the status in another 118
Published in the DOGC of 19 October, the declarations activate the rent containment regime of the right to housing law in the new municipalities.

The Government of Catalonia has significantly expanded the map of the stressed residential market. Resolution TER/3740/2026, of 16 October, declares 53 municipalities of Catalonia stressed residential market areas, and Resolution TER/3739/2026 extends the declaration in another 118 municipalities that already held it. Both were published in the DOGC of 19 October, as recorded by ICAB on its regulatory page.
The declarations rest on Law 12/2023, of 24 May, on the right to housing, which allows the autonomous communities to delimit stressed residential market areas when there are risks of displacement or disproportion between the rental burden and household income.
What effects the declaration has
In the declared areas, the rent containment regime of articles 17 and 18 of Law 12/2023 is activated: in new contracts, the price is referenced to the state rental price reference system, with a reinforced regime for landlords holding the status of large holders. The declaration lasts three years, extendable annually, hence the second resolution, which extends validity in the 118 municipalities already declared.
For real estate and family lawyers, the operational impact is immediate: contracts signed in these municipalities must check the reference price before fixing the rent, and update clauses are subject to the reference index for housing leases.
A map that keeps growing
With this declaration, practically all of Catalonia's urban rental market under residential pressure falls under the special regime. The trend is not exclusive to Catalonia: other autonomous communities have activated or are studying equivalent declarations under the same law, and each new resolution forces a review of contract portfolios and lease templates. For owners and tenants, the first practical check is whether the property's municipality appears in the declaration in force on the contract signing date.
What operators should review
For advisers and firms with landlord clients in Catalonia, the declaration forces an immediate review on three fronts: existing contracts whose renewal or new contract falls after the declaration takes effect, contract templates that do not contemplate the reference price, and pre-signing communications when the landlord is a large holder, subject to the reinforced regime. Conversely, tenants in the new municipalities gain a clear legal argument against increases exceeding the law's framework.
The reasonable doubt: duration and extensions
The law sets the declaration at three years, extendable annually, and Resolution TER/3739/2026 shows the Generalitat uses that extension: the 118 original municipalities remain inside. The practical effect is that the special regime ceases to be a temporary exception and becomes the ordinary framework of Catalan urban renting, something owners, tenants and operators must build into their medium-term expectations, not as a passing situation.
Sources and verification
This report is based on the text of the resolutions published in the DOGC of 19 October 2026 and on the consolidated text of Law 12/2023 in the BOE, both linked below. The list of affected municipalities appears in the annexes of each resolution and should be checked before applying the regime to a specific contract.
The regulatory context of renting
Rental market tension keeps producing rules at a pace that demands continuous monitoring. At state level, the last major piece is the rental contract extension under Royal Decree-Law 28/2026, and on the emergency legislative technique in housing we wrote the editorial Housing decree-laws and legal certainty.
