More benefits with a frozen contribution: what changes for the self-employed lawyer from 1 January 2027

The Government extends the assumptions for contribution relief and upgrades several benefits of the special regime, with effects already from the new year.

The Government has approved an extension of the cases in which self-employed workers can keep their social security contributions frozen without losing entitlement to improved benefits. The measure, included in Royal Decree-Law 31/2026, takes effect from 1 January 2027 and directly affects the more than 100,000 lawyers practising on a self-employed basis in Spain.

What the contribution freeze means

The freeze allows self-employed workers in certain situations - low income, caring responsibilities, restart after cessation - to maintain their contribution base without the increase that would otherwise apply under the real-income system. The decree extends the subjective and objective cases: more situations qualify and for longer periods.

For the self-employed lawyer, the key lies in the real-income contribution brackets: those whose net income places them in the lower brackets will be able to access the freeze more easily, with a direct effect on monthly liquidity.

Benefits that improve

The regulation does not only freeze contributions: it improves several benefits of the special regime for self-employed workers (RETA). Among the most relevant for the legal profession, the reinforcement of coverage for temporary incapacity and the improvement of compatibility between benefits and professional activity in cases of partial cessation.

The change matters because the self-employed lawyer's income depends directly on their capacity to practise: an improvement in incapacity coverage is, in practice, an income insurance.

The real-income system, three years on

The contribution system based on real income entered into force in 2023 and has been adjusted every year since. Its logic - those who earn less pay less, those who earn more pay more - has reduced the contribution for most low-income self-employed, but it has also introduced a new administrative complexity: the annual regularisation, in which the Treasury and Social Security cross-check declared income and settle differences.

Lawyers are one of the collectives with the widest income dispersion within the regime: the same professional category includes the sole practitioner in a small town and the partner of a boutique billing six figures. The freeze cases in the decree are aimed precisely at the lower part of that spectrum, where the monthly contribution weighs most against net income.

The collective's pending demands

The professional associations of self-employed lawyers have welcomed the freeze but keep two pending demands on the table: the full deductibility of contributions and benefits as a professional expense, and the recognition of cessation-of-activity coverage adapted to the practice of law, whose income interruptions rarely fit the standard unemployment patterns of the regime.

What to review before January

Advisers recommend that self-employed lawyers review three points before the end of the year: the contribution bracket assigned under the real-income system and whether an adjustment is appropriate; compatibility between the freeze and mutual society coverage, for those who opted for a mutual insurance alternative; and the impact on the professional civil liability policy, whose requirements interact with RETA coverage.

A gradual reform

The measure is part of the progressive deployment of the real-income contribution system, which completed its third year in 2026. Each annual adjustment has shifted the balance between contribution and protection, and the 2027 package is the first to combine a broad freeze with simultaneous improvements in benefits.

The Ministry of Inclusion has announced that the implementation details will be specified in a ministerial order before the end of the year, including the procedure for requesting the freeze and the documentation to be provided.
