The 23rd Ibero-American Judicial Summit, held in Brasilia on 19 and 20 October 2026 under the motto "Artificial Intelligence and Justice", has given rise to the Ibero-American Guide of Good Practices for the Use of Artificial Intelligence in Case Law, a 45-page document of Thematic Axis 1, devoted to the Ibero-American platform of intelligent case law, document management and judicial data.

What the guide proposes

The document proposes a common basis for incorporating AI into the preparation, protection, publication, search and use of Ibero-American case law. Its stated purpose is to improve access to legal knowledge and the quality of documentary and judicial work, preserving independence, human responsibility and people's rights.

The platform is conceived as an ecosystem of national services connectable through shared standards, respecting each institution's competences and access conditions. The diagnosis draws on the comparative report of the questionnaire submitted by the countries participating in the project.

From principles to verifiable controls

The guide's core idea is that principles must become responsibilities and verifiable controls. It requires each initiative to have an authority that authorises the use, a unit responsible for the service, data and security officers, legal and documentary validation, maintenance resources and the capacity to suspend the service.

On training, the document is blunt: practical training must enable users to check sources, recognise errors, protect information and reject inadequate results. And it warns that purchasing a tool or attending a talk does not by itself accredit the necessary institutional capacity.

Gender and data protection as cross-cutting axes

Governance and evaluation incorporate the gender perspective across the board, with interdisciplinary participation, equality and non-discrimination indicators and preventive analysis of effects on people and groups. Data protection is integrated into the design of each service, consistent with the requirement that ultimate responsibility for judicial decisions remains with people.

Version control

The guide's own version control records version 1.0 (19 October, adoption of the draft Guide), 1.1 (20 October, contributions from the members of the Working Group) and 1.2 (20 October, contributions from the Gender Commission). The cover of the document consulted reads "Version 1.0".
